By accessing or using RCS Draft ("we", "us", or "our"), you agree to these Terms of Service. If you do not agree, do not use the service.
RCS Draft is a workflow preparation tool. It assists appraisers in drafting HUD Form 92273-S8 workbooks and supporting narrative addenda by automating data retrieval, formula integrity, and formatting. RCS Draft does not perform appraisal services, does not certify any valuation, and does not replace or reduce the appraiser's professional obligations.
Appraiser's Professional Responsibility.The certified general appraiser retains 100% responsibility for verifying all data, reviewing all Chapter 9 adjustments, exercising independent professional judgment, and certifying and signing the final submission. Every dollar adjustment, market-rate confirmation, and narrative conclusion in the exported workbook must be reviewed and approved by the appraiser before submission to HUD or any other party. RCS Draft's role is limited to preparation assistance — the appraiser is the signatory.
No Warranty.RCS Draft is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, accuracy of third-party data, or uninterrupted availability.
Limitation of Liability.To the fullest extent permitted by law, RCS Draft and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or reliance on the software, including but not limited to HUD review outcomes, rejection of submissions, or any professional consequences of submitted work product. The appraiser's sole remedy for dissatisfaction with the service is to discontinue use.
Third-Party Data.Real estate and rental data is sourced from RentCast, a third-party provider. RCS Draft does not guarantee the accuracy, completeness, or timeliness of third-party data. Verification of all sourced data against independent records is the appraiser's responsibility.
RCS Draft is provided for use by licensed and certified professional appraisers and their firms in preparing HUD Rent Comparability Studies. You agree not to scrape, reverse-engineer, or programmatically access the service outside its intended workflow, resell or sublicense access to the service, or submit work product on behalf of an unlicensed practice.
RCS Draft is provided without a guaranteed uptime commitment or service-level agreement. The service may be unavailable for maintenance, updates, or reasons outside our control.
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of law principles. Any dispute arising from your use of RCS Draft shall be submitted to the exclusive jurisdiction of the courts of Vilnius, Lithuania.
Notwithstanding the foregoing, if mandatory consumer protection laws in your country of residence provide you with the right to bring a claim in your local courts, you may do so. Nothing in these Terms limits any statutory rights that cannot be waived under applicable law.
We may update these Terms from time to time. Material changes will be reflected in an updated "Last updated" date at the top of this page. Continued use of RCS Draft after a change constitutes acceptance of the revised Terms.
